CHIRP Board Raffle Rules

"The 2nd Annual CHIRP Radio Board of Directors Fundraising Raffle - Get Your Second Shot at Fabulous Prize Packages" (the”Raffle”) is being conducted by CHIRP Radio, a 501(c)(3) not-for-profit charitable organization. The Raffle is being conducted pursuant to the Illinois Raffles Act, 230 ILAFC 15/0.01 et seq. and the City of Chicago Municipal Code 4-156, to raise funds for ongoing charitable purposes. CHIRP Radio’s Official Rules and Regulations (the “Official Rules”) are set forth below. By purchasing a Raffle entry (an “Entry” or “Entries”), the purchaser acknowledges that they are aware of, and agrees to be bound by, these Official Rules and CHIRP Radio’s interpretation of any such Official Rules. CHIRP Radio shall be responsible for interpreting and applying the Official Rules. CHIRP Radio’s interpretation and application of such rules shall be final.

Eligibility: The Raffle is open only to residents in the state of Illinois who are at least twenty-one (21) years of age at the time of the Raffle, except employees, directors and officers (or any persons who have been employees, directors or officers in the past twelve months) of CHIRP Radio or prize suppliers and their affiliates, partners, subsidiaries, franchises, distributors, retailers, advertising and promotion agencies, and the immediate families or household members of each. The Raffle is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law or regulations.

The Raffle begins at 6:00am CT on Monday, October 11, 2020 and ends at 11:59 p.m. CT on Friday, October 30, 2020 (“Raffle Period”). Entries may be purchased in the following groupings: ten dollars ($10) for ten (10) entries; twenty-five dollars ($25) for thirty (30) entries; or fifty dollars ($50) for seventy-five (75) entries. The number of Entries within a grouping cannot be divided towards the entry of multiple baskets, but all must be entered towards the chance to win one basket.

How to enter:  An eligible person can purchase as many entries as they wish. Only the name of one eligible entrant can be provided on an entry form, joint entries are not allowed. The division of any prize among a group of persons purchasing entries in common is the sole responsibility of the person named as the holder of record of that entry if that entry is selected as a winner.

Follow the instructions to complete the order form and submit payment. CHIRP Radio reserves the right to reject any entry form that is submitted without proper payment or payment that does not constitute “good funds.”  No refunds will be made for the purchase of Entries.

Prize(s): Five (5) winners will receive one of the five Grand Prize Raffle packages, each valued at $250 minimum. Each winner can win only one (1) Grand Prize Raffle package.

Everyone who buys at least one entry will also automatically be entered to win one of two (2) Bonus Prizes, a set of AfterShokz Air Wireless Bone Conduction headphones. Bonus prizes will be awarded by random drawing among those who did not win one of the five (5) Grand Prize Raffle packages.

Winner will be responsible for all expenses not specifically included herein, and all applicable federal, state and local taxes and other fees. Prize is non-transferable and no substitution by winner or cash equivalent is allowed. CHIRP RADIO reserves the right to substitute prize for one of equal or greater value.  

Selection of winner:  Five (5) different Grand Prize Raffle packages winners and two (2) Bonus Prize winners will be selected by random generation of a winner on Saturday, October 31,2020. Only one prize per person and per household will be awarded.  Should the same person or household be selected two or more times, another random winner will be generated until five separate people and households are drawn. Odds of winning depend on the number of eligible Entries received. Judges’ decisions are final and binding in all matters relating to this Raffle. Winners may be notified by telephone or e-mail before or by November 2, 2021. Prizes will be sent to winners by USPS.  If a selected winner is unable to be contacted or located after a period of one (1) month from the Raffle drawing date of October 31, 2021 the prize or its cash equivalent will be deemed to have been donated to CHIRP Radio.  

Non-Deductibility of Raffle Entry Purchase: The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently, the purchase of an Entry does not qualify as a deductible charitable contribution.

Release of Liability: By participating, you release CHIRP Radio, its sponsors and underwriters, respective subsidiaries, affiliates, partners, employees, directors, agents, and all other associated with the development and execution of this Raffle, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Raffle and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize.

By entering, you further agree that (i) any and all disputes, claims, and causes of action arising out of or in connection with the Raffle or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Raffles, but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

Additional Rules:  Entry materials or data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void.  No responsibility is assumed for: (i) lost, late, misdirected, damaged, garbled, postage due or illegible entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by CHIRP Radio or its agents on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Raffle.

By participating in the Raffle, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of judges, which are final and binding in all matters relating to the Raffle.  Failure to comply with these official rules may result in disqualification from the Raffle.

These Rules and this Raffle are governed by and controlled by the laws of the State of Illinois, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the State of Illinois, Cook County. The parties consent to the jurisdiction of the state courts of Illinois and the federal courts located with such state and county with respect to any action, dispute or other matter pertaining to or arising out of this Raffle. Entry constitutes consent to post the winner's name on the CHIRP Radio website and to use the prize winner's name, voice, picture and/or likeness without compensation for promotion or advertising purposes.

Privacy: By entering the Raffle, you agree to receive informational and promotional communications periodically from CHIRP Radio.  If you want to opt-out of receiving communications from CHIRP Radio, make your request to development@chirpradio.org. LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE RAFFLE, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND CHIRP RADIO RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Cancellation/Termination of Raffle: By purchasing an Entry and choosing to participate in the Raffle, each Raffle participant acknowledges and agrees that CHIRP Radio has the right, in its sole discretion, to elect not to proceed with the Raffle for any reason whatsoever or for no reason, and in such event, a participant’s sole and exclusive remedy shall be to receive a refund of the full price paid by such participant for each Entry purchased, without interest.

Registration with the State of Illinois: CHIRP Radio has registered with the City of Chicago under Raffle License Number 2748964. The Raffle License Number will be published in all marketing materials where possible.
